The penalties a court can impose vary depending on the category of drink-driving. Drink-driving offences are categorised by reference to how much alcohol was in the person’s system at the time of the offence.

Generally there are four main categories of drink driving offences:

special range PCA, which applies to people on a provisional licence and who have a alcohol concentration of between 0.0 to 0.049.
low range PCA which applies to drivers with a blood alcohol concentration of between 0.05 and 0.79.
mid-range PCA which applies to drivers with a blood alcohol concentration of between 0.08 and 0.1494
high range PCA which applies to drivers with a blood alcohol concentration of over 0.15.

The penalties a court can impose for a drink-driving offence can change if there have been previous drink-driving offences or other major traffic offences in the five-year period before the current offence.
